¿Qué sucede si llego a la jubilación cobrando la pensión de incapacidad permanente?
El beneficiario de la pensión de incapacidad permanente cuando llega a la edad legal de jubilación pasa a ser beneficiario de la pensión de jubilación, sin que se modifiquen las condiciones de la prestación; No se modifica, por tanto, la cuantía de la pensión.
Tampoco este cambio de denominación tiene efectos en la retención practicada en el IRPF; Las pensiones de incapacidad permanente cuando son reconocidas en el grado de absoluta (cuando su estado no le permite desarrollar ninguna actividad laboral) y gran invalidez (cuando se precisa la ayuda de una tercera persona para realizar los actos básicos de la vida) no están sometidas a IRPF.
NOTAS: Incompatibilidad entre pensión de jubilación y pensión de incapacidad permanente en el mismo régimen
La pensión de incapacidad permanente y la pensión de jubilación del mismo régimen son incompatibles, de modo que deberá optarse por una de ellas.
Si el beneficiario ha estado desarrollando la actividad laboral en el mismo régimen de la Seguridad Social, tendrá dos opciones:
La primera posibilidad es optar por la pensión de incapacidad permanente que estaba percibiendo. Entonces se mantendrá la misma cuantía que estuviese percibiendo y se cambiará la denominación.
Si se opta por la pensión de jubilación, que seguramente será más favorable, se calculará la prestación teniendo en cuenta todas las cotizaciones del beneficiario, incluidas las que en su momento se emplearon para calcular la pensión de incapacidad permanente que se estaba percibiendo y que ahora se extingue.
La pensión de incapacidad permanente y la pensión de jubilación del mismo régimen son incompatibles, de modo que deberá optarse por una de ellas.
Si el beneficiario ha estado desarrollando la actividad laboral en el mismo régimen de la Seguridad Social, tendrá dos opciones:
La primera posibilidad es optar por la pensión de incapacidad permanente que estaba percibiendo. Entonces se mantendrá la misma cuantía que estuviese percibiendo y se cambiará la denominación.

NOTAS: Compatibilidad de la pensión de incapacidad permanente y pensión de jubilación en distintos regímenes
En caso de pluriactividad, es decir, cuando se cotiza a dos regímenes diferentes al mismo tiempo (por ejemplo, al régimen general como trabajador por cuenta ajena y al régimen de autónomos como trabajador por cuenta propia) es posible que posteriormente sea posible la compatibilidad de la pensión de jubilación y de la incapacidad permanente, si cada una de ellas se reconoce en un régimen distinto. En este contexto, son posibles dos situaciones:
No será posible la compatibilidad entre las dos pensiones, cuando para calcular la pensión de incapacidad permanente se tuvieron en cuenta las cotizaciones de los dos regímenes.
Si para generar el derecho a la pensión de incapacidad permanente hubo que acudir al régimen donde ahora se pretende obtener la pensión de jubilación, en este caso, habrá que optar por una de ellas.
Si las cotizaciones del régimen por el que se reconoce la jubilación sirvieron únicamente para cuantificar el importe de la incapacidad permanente, pero, se pueden prescindir de dichas cotizaciones y se mantiene el derecho a la incapacidad permanente, se tendrá derecho a ambas.
En este supuesto, cada una de las pensiones se calculará de acuerdo con las cotizaciones de cada uno de los regímenes a los que se ha cotizado.
Así, será preciso recalcular la pensión de incapacidad permanente.
